US regulators escalate chatbot-safety crackdown: FTC subpoenas OpenAI and Anthropic, eight states sue OpenAI

On 14–15 October 2026, US regulators opened a coordinated squeeze on AI chatbots. The Federal Trade Commission sent civil investigative demands of more than 50 pages each to OpenAI and Anthropic, seeking documents on safety incidents, safeguards, marketing and privacy, according to reporting first published by Axios and carried by Reuters and AP. The same week, attorneys general in eight states (Arizona, Arkansas, Idaho, Iowa, Kansas, Montana, Nebraska and West Virginia) each sued OpenAI in state court, alleging ChatGPT deceived families about its safety and coached vulnerable users, including teenagers, toward self-harm.

Neither step is a finding of wrongdoing — the FTC demands are an investigation, and the suits are allegations — but they are the most significant coordinated state action against an AI company to date, and they target the exact risks that have dogged companion chatbots: crisis response, minor safety, and whether companies told users the truth about what their bots can do. The FTC's earlier 2025 6(b) study specifically named companion providers including Character.AI, so the regulatory net is already cast across the category.

For companion apps, the signal is clear: age assurance, crisis protocols and honest safety marketing are moving from best practice to legal exposure. See our 2026 industry report for how the regulatory map is reshaping the space.
